రెండు రకాలు:

వ్యవసాయ భూమిలో రెండు రకాలు ఉంటాయి. మొదటిది గ్రామీణ ప్రాంతాల్లో వ్యవసాయ భూమి, రెండోది పట్టణ ప్రాంతాల్లో వ్యవసాయ భూమి. ఆదాయపు పన్ను దృక్కోణంలో వ్యవసాయానికి ఉపయోగించే అన్ని రకాల భూమిని వ్యవసాయ భూమిగా పరిగణించరు. ఆదాయపు పన్ను చట్టంలోని సెక్షన్ 2 (14)లోని నిబంధనలను సక్రమంగా ఉండకపోతే.. మీ వ్యవసాయ భూమిని వ్యవసాయ భూమిగా పరిగణించలేరు.

పరిధి చూడాలి:

ఎగ్జాంపుల్ ఏంటంటే.. మీ వ్యవసాయ భూమి మున్సిపాలిటీ, షెడ్యూల్డ్ ఏరియా కమిటీ, సిటీ ఏరియా కమిటీ, కంటోన్మెంట్ బోర్డు పరిధిలోకి వచ్చి 10 వేలు లేదా అంతకంటే ఎక్కువ జనాభా కలిగి ఉంటే, ఆదాయపు పన్ను చట్టం ప్రకారం అది వ్యవసాయ భూమిగా పరిగణించరు. మున్సిపాలిటీ లేదా కంటోన్మెంట్ బోర్డు జనాభా 10 వేల కంటే ఎక్కువ నుంచి 1 లక్ష వరకు ఉంటే అప్పుడు 2 కిలో మీటర్ల వ్యవధిలో ఉన్న భూమిని వ్యవసాయ భూమిగా పరిగణించరు. ఒకవేళ మున్సిపాలిటీ లేదా కంటోన్మెంట్ బోర్డు ప్రాంతంలో జనాభా 1 లక్ష కంటే ఎక్కువ, 10 లక్షల వరకు ఉంటే.. అప్పుడు 6 కి.మీ లోపు మొత్తం ప్రాంతం వ్యవసాయ భూమిగా పరిగణించరు అని గుర్తించాలి. అదేవిధంగా మున్సిపాలిటీ లేదా కంటోన్మెంట్ జనాభా 10 లక్షల కంటే ఎక్కువ ఉంటే దాని 8 కిలోమీటర్ల పరిధిలోని భూమిని వ్యవసాయ భూమిగా పరిగణించరు.

మూలధన ఆస్తి:

ఒకవేళ మీ వ్యవసాయ భూమి పైన చెప్పిన నిర్దిష్ట సరిహద్దుల్లో లేకుంటే అది ఆదాయపు పన్ను పరిధిలోకి వస్తుంది. ఆదాయపు పన్ను చట్టం ప్రకారం, వ్యవసాయ భూమిని మూలధన ఆస్తిగా పరిగణించరు. అందువల్ల విక్రయించినప్పుడు వచ్చే ఆదాయంపై మూలధన లాభాల పన్ను విధించదు. కానీ ఇక్కడ అసలు విషయం ఏంటంటే.. ఒకవేళ మీ వ్యవసాయ భూమి పైన పేర్కొన్న ప్రాంతాల పరిధిలోకి వస్తే మాత్రం అది మూలధన ఆస్తిగా పరిగణిస్తారు.

24 నెలలు:

నగరానికి చెందిన వ్యవసాయ భూమిని మీరు 24 నెలల పాటు కలిగి ఉండి, ఆపై విక్రయించినట్లయితే దాని నుండి వచ్చే లాభం దీర్ఘకాలిక మూలధన లాభంగా పరిగణించబడుతుంది. ఇండెక్సేషన్ ప్రయోజనంలో 20 శాతం పన్ను దానిపై విధిస్తారు. వ్యవసాయ భూమిని కొనుగోలు చేసిన 24 నెలలలోపు విక్రయించినట్లయితే లాభంపై స్వల్పకాలిక మూలధన లాభాల పన్ను విధిస్తారు. మూలధన లాభం మొత్తం మీ పన్ను స్లాబ్ ప్రకారం లెక్కిస్తారు.

ఇలా ఆదా చేసుకోవచ్చు:

అయితే సెక్షన్ 54(బి) ప్రకారం మీరు నిబంధనలకు లోబడి మరొక వ్యవసాయ భూమిని కొనుగోలు చేయడం ద్వారా మూలధన లాభాల పన్నును ఆదా చేయవచ్చు. మీ భూమి గ్రామీణ ప్రాంతంలో ఉందా? లేక పట్టణ ప్రాంతంలోనా? అనేది క్లారిటీ ఉండాలి. ఆదాయపు పన్ను శాఖ తన ప్రమాణాల ఆధారంగా పన్ను నిర్ణయాలను తీసుకుంటుంది.
